Interplay Between the DGA, the Data Act the GDPR and the Potential Effects of Data Altruism on AI Development

Data is central to digital transformation, fueling innovation and economic growth. The European data strategy aims to create a unified data space across Europe to enable secure, open and interoperable data use, supporting advancements in AI and other technologies. The EU's vision includes a borderless digital market with sector-specific data spaces, such as in health and mobility. The Data Governance Act (DGA) fosters growth in the European data economy, especially for SMEs and startups, by ensuring data access neutrality, portability and interoperability, while preventing vendor lock-in. Covering both personal and non-personal data, the DGA works alongside GDPR and ePrivacy rules, with GDPR and ePrivacy taking precedence in case of conflicts. This alignment reinforces personal data protection within the broader data economy framework.
